ELYRIA — The mother of Tyler Marrero has filed a lawsuit against the man responsible for her son’s death, Danny Emery.
Shelley Marrero filed a lawsuit in Lorain County Common Pleas Court last week against Emery for the wrongful death of Tyler Marrero, “negligence and recklessness” that led to her son’s death and demonstrating “malice and a conscious disregard for the rights and safety” of her son.
Emery was charged with aggravated vehicular homicide and failure to stop after a Nov. 5, 2016, crash between his 2007 Chevrolet Cobalt and 23-year-old Tyler Marrero’s motorcycle on North Ridge Road in Elyria Township.
Prosecutors have said Emery’s car cut off Marrero’s motorcycle, causing the motorcycle to hit a rear quarter panel. The motorcycle overturned and Emery fled the scene. Prosecutors also have said the crash was a result of street racing.
Emery has had more than nine citations for speeding and some for traveling at speeds as high as 106 mph, prosecutors have said.
In July, Emery was sentenced to six months in a community-based correctional facility after previously pleading guilty to a third-degree felony count of aggravated vehicular homicide and failure to stop after a crash.
Visiting Judge Robert Brown said he would suspend a five-year sentence in the case and instead place Emery on five years of probation after serving his six months. Emery also was ordered to pay $4,037 in funeral costs and will have his driver’s license suspended for 10 years.
In a statement to Brown, Emery said he “was sorry” for taking the life of Tyler Marrero but requested leniency because he was the sole breadwinner for his three sons and long-term girlfriend.
At Emery’s sentencing in July, Shelley Marrero placed an urn on one of the attorney’s tables in the courtroom and said, “I brought my son with me. He sits on my mantle at home. This is all I have left. This and his baby, Adrian.”
